OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES OF AMERICA (EXCLUDING PUERTO RICO AND ITS OTHER TERRITORIES AND POSSESSIONS), THE UNITED KINGDOM, CANADA (EXCLUDING THE PROVINCE OF QUEBEC), INDIA, BRAZIL, GERMANY AND AUSTRALIA.

  1. SPONSOR: The sponsor of this promotion is NVIDIA CORPORATION (“ NVIDIA ”), with offices at 2701 San Tomas Expressway, Santa Clara, CA 95050, U.S.A.

  2. PRIZES; ODDS OF WINNING: The prizes of this promotion consist of the following: one (1) first-place winner will receive a GeForce GTX 560 with an estimated retail value of US$199; and four (4) second-place winners will each receive a US$25 Amazon.com Gift Certificate with a total estimated retail value of US$ $100; Odds of winning depend on the number of eligible entries received. The prizes are not assignable or transferable, and are not redeemable, exchangeable or substitutable for cash.

  3. HOW TO ENTER: You may enter this promotion in one of two ways: (a) by completing the NVIDIA Products Usability Survey which can be accessed via the link included in the feedback survey email sent to you; or (b) by mailing a postcard with your name and contact information to NVIDIA Usability Survey Sweepstakes – Entries by Mail , NVIDIA Corporation, 2701 San Tomas Expressway, Santa Clara, CA 95050, U.S.A. In order to receive the feedback survey email, please visit www.nvidia.com/usability. This promotion is limited to one entry per person.

  4. ELIGIBILITY: This promotion is open to all legal residents of the United States of America (excluding Puerto Rico and its other territories and possessions), the United Kingdom, Canada (excluding the province of Quebec), India, Brazil, Germany and Australia who have attained the age of majority under the laws of the country or state of residence as of the start of this promotion. However, persons in any of the following categories are not eligible to participate or to win a prize: (a) persons who from and after May 19, 2011 were or are employees or agents of NIVIDA or its affiliates, parent, subsidiaries, or the service agencies or independent contractors of the above organization(s); (b) persons who are engaged in the development, production, distribution of materials, or drawing of winners for this promotion; and (c) persons who are immediate family of or who reside in the same household as any person in either of the preceding categories.

  5. ENTRY PERIOD: The entry period for this promotion (the “ Entry Period ”) will begin at 12:01 a.m. Pacific Daylight Saving Time on May 19, 2011 and will end at 11:59:59 p.m. Pacific Daylight Saving Time on May 31, 2011. “Pacific Daylight Saving Time” refers to that observed in the United States of America. It is entirely each participant's responsibility to observe time zone differences.

  6. DRAWING: After the end of the Entry Period, winners will be selected from all online and mailed-in entries through a random drawing to be conducted by a representative of NVIDIA at NVIDIA's corporate office located at 2701 San Tomas Expressway, Santa Clara, CA 95050, U.S.A. The decision of such NVIDIA representative will be final and binding in all respects. Winners will be notified via email based on the email addresses specified in their entries, within five (5) business days after the drawing. Each winner must reply to the notification email to claim prize within 120 hours from the time the notification email is sent, or prize will be considered forfeited. Unclaimed prizes may be retained by NVIDIA or awarded to alternate winners selected by NVIDIA or otherwise disposed of by NVIDIA at its sole discretion . Each winner will be required to sign and return an affidavit and release to NVIDIA, and the prize will be shipped to the winner, at NVIDIA's expense, within thirty (30) days upon NVIDIA's receipt of such signed affidavit and release from the winner.

    7. SPECIAL NOTICE TO CANADIAN ENTRANTS: THE PERSON SELECTED RANDOMLY WILL BE REQUIRED TO CORRECTLY ANSWER A MATHEMATICAL QUESTION INVOLVING AT LEAST FOUR OPERATIONS THAT INVOLVE AT LEAST TWO DIGIT NUMBERS.

(a) NVIDIA reserves the right to cancel, terminate, modify or suspend this promotion or any portion thereof, if this promotion or any website associated therewith (or any portion thereof) becomes corrupted or otherwise does not permit or accept entries, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in NVIDIA's sole opinion, corrupt, impair or otherwise affect the administration, security, fairness, integrity, or proper operation of this promotion. NVIDIA also reserves the right, at its sole discretion, to disqualify any entrant implicated in any conduct or activity that may disrupt, corrupt, impair or otherwise affect the integrity or operation of this promotion. Any attempt by an entrant or any other individual to deliberately damage any online service or web site or undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made NVIDIA reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law.

    (b) Use of any automated entry software is prohibited. Entries made with multiple e-mail addresses, under multiple identities or through the use of any other device or artifice to enter multiple times will be deemed invalid. A winning online entry will be deemed to have been submitted by the authorized account holder of the e-mail address from which the entry was made. The authorized email account holder is deemed as the natural person who is assigned to an e-mail address by an internet access provider, service provider or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address.

    (c) NVIDIA makes no warranty or representation as to any of the prizes and is not liable if you experience technical difficulties, due to reasons not attributable to NVIDIA, including, but not limited to, manufacturing defects, model incompatibility, and restrictions imposed by the manufacturer.

    (d) NVIDIA shall not be responsible for (a) any communication, connectivity or technical errors, failures, malfunctions, interruptions or delays that are attributable to computer hardware, software, network, cable, phone, Internet access, or other means or media of communication owned, controlled, used, or provided by entrants or any third parties, (b) any errors, omissions, misinformation, or misidentification in an entry, or (c) any late, lost, stolen, postage unpaid, incomplete, illegible or misdirected entries. It is entirely each entrant's responsibility to ensure that his/her designated email address is accurate, valid and operative, and that his/her designated mailing address is capable of receiving packages sent by international courier. By entering this promotion, each entrant acknowledges and agrees that in no event shall NVIDIA be responsible or liable if its email notification or delivery of prize to a winner is undeliverable, returned, rejected or blocked due to reasons not attributable to NVIDIA (for example, NVIDIA shall not be responsible if its email notification sent to a winner is returned or blocked by firewall or security/privacy settings on the system, network or service used by the winner).

    (e) By participating in this promotion, you: (a) agree to be bound by these Official Rules and the decisions of NIVIDA; (b) agree to release and hold harmless NIVIDA, its affiliates, subsidiaries, and independent contractors, and its and their respective directors, officers, employees, and agents, including advertising and promotion agencies, from any and all liability with respect to your acceptance, possession or use (or misuse) of the prizes or participation in this promotion; and (c) agree to permit NIVIDA to use your name and entry information as necessary to conduct, administer, advertise and publicize this promotion for no additional compensation.

    (f) By participating in this promotion, you expressly consent to NVIDIA's collection, processing and use of his/her personal information provided in your entry as necessary to conduct and carry out this promotion (including, but not limited to, entering you into this promotion, communicating with and awarding the prize to you should you be selected as the winner, and making public announcements about the winners). In addition, it is optional for you to consent to NVIDIA's marketing use of your personal information in accordance with NVIDIA's privacy policy at http://www.nvidia.com/object/privacy_policy.html.

    •  NVIDIA is the data controller and the data recipient for this promotion.

    •  Your personal information is collected and processed for purposes of conducting and administering this promotion.

    •  You have a right to access, update, delete or withdraw your personal information collected and processed by NVIDIA in connection with this promotion, by emailing your request to ux-feedback@nvidia.com. For your protection, NVIDIA may require verification prior to making an update or change to your personal information previously submitted. NOTE: If you delete or withdraw your personal information during this promotion, NVIDIA may be unable to notify or award the prize to you should you be selected as a winner.

    •  Your personal information will be transferred to the United States of America.
