Privacy Policy for NVIDIA Career Applicants

Thank you for your interest in joining our team. NVIDIA collects personal information (“Recruiting Data”) as part of our career application process, and this Privacy Policy for NVIDIA Career Applicants (“Applicant Privacy Policy”) details what information we collect, and how we use that information. This Applicant Privacy Policy applies only to our recruiting process. Please refer to our NVIDIA Privacy Policy for information on how we collect and process data for specific NVIDIA services and products.

We collect Recruiting Data for recruitment, assessment, and hiring purposes. Categories of information we may collect (where permitted by applicable law) include:

RECRUITMENT
  • Personal contact information such as your name, phone number, email address, and mailing address;
  • Demographic information (with your consent) such as race/ethnicity, gender (male/female/decline to state/diverse), and veteran status;
  • Education information, such as current or past schools attended; and
  • Inferences such as interests, preferences, and certain demographic information based on other personal information we collect and the interactions we have with job applicants.

ASSESSMENT

  • Education background such as schools attended and degrees obtained;
  • Internship and/or work history; and
  • Other information provided by you or collected during the interview process, including feedback from interviews.

HIRING

  • Citizenship information (unless prohibited in the relevant jurisdiction);
  • Government-issued identity numbers;
  • Results of background checks, which include identity verification, education history, work history, and criminal history, to the extent such checks are permitted in the relevant jurisdiction;
  • For certain positions such as those involving finance, financial credit checks, to the extent such checks are permitted in the relevant jurisdiction; and
  • Contact information for work references that you have identified, and feedback from those references regarding your work history and performance, to the extent such checks are permitted in the relevant jurisdiction.

How We Collect Recruiting Data

We collect Recruiting Data from:

  • You, when you provide your information at conferences, events, or through our online forms, including through the application portal;
  • Public sources and social media such as LinkedIn;
  • NVIDIA employees who may have provided your information with your consent;
  • Third parties such as conference organizers with whom you have shared your information knowing that it will be shared with NVIDIA; and
  • Service providers and other third parties that collect it on our behalf, such as communications providers, recruitment platform providers, scheduling providers, and application providers.

How We Use, Store, and Share Recruiting Data

We use Recruiting Data consistent with applicable laws for recruitment, assessment, hiring, and to comply with record keeping and reporting requirements as well as to plan and improve NVIDIA’s inclusion and diversity efforts and programs.

As part of our assessment process, we also use Recruiting Data to help us find well qualified applicants. For example:

  • If you expressed interest in a particular field through one of our online forms, or to a recruiter at a conference or recruiting event, we will use contact information you provided (with your consent where required by applicable law) to share relevant news or blog updates and to inform you – including through email, phone, text, or social media –  when a position you may be interested in becomes available.
  • If you have applied for a specific position and were not selected, but we believe you may be well suited for another position, we will retain your data (with your consent) and may contact you and inform you of other position(s).

We do not “sell” your personal information for monetary or other valuable consideration or “share” your personal information for targeted advertising when this information is collected from you as a “job applicant”. However, as part of your visit to our websites generally, we disclose personal information to social media, advertising, and analytics partners for performance improvement, analytics, and to assist in our marketing efforts. This activity is not covered under this Applicant Privacy Policy; instead, please review the NVIDIA Privacy Policy to learn more. We do not have actual knowledge of “selling” or “sharing” any personal information of anyone under sixteen (16) years of age.

Research and Development. We use Recruiting Data to develop and improve HR technologies that help us identify and match potential candidates with specific jobs. We may remove personally identifying information from your resume and use it to develop or improve these technologies. All recruiting and hiring decisions are ultimately made by our recruiters and hiring managers.

Transfer and Storage of Data. NVIDIA is located in California, and in most cases we need to securely transfer and store your information in the USA. To meet data protection requirements, we are a member of the EU-U.S. and Swiss-U.S. Data Privacy Frameworks (“DPFs”), and we are subject to enforcement by the U.S. Federal Trade Commission. This means we adhere to the Data Privacy Framework Principles with regard to the processing of personal data received from the European Union in reliance on the DPFs, including the UK Extension to the EU-U.S. DPF. In addition, all personal data transferred to the USA is governed by the EU Standard Contractual Clauses which guarantee the privacy and security of your data.

We are subject to U.S. law, and we may be required to share data with U.S. law enforcement agencies. For inquiries or complaints, you should first contact privacy@nvidia.com. NVIDIA has further committed to refer unresolved privacy complaints under the DPFs to an independent dispute resolution mechanism, Data Privacy Framework Services, operated by BBB National Programs. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit here. This service is provided free of charge to you. If your DPF complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. Data retention. We retain Recruiting Data for as long as you continue to interact with us by applying for jobs or expressing interest in career opportunities. If you stop interacting with us, we will retain your Recruiting Data for no more than five years, unless a shorter retention period is set by local law.

Sensitive Information

The following personal information elements we collect may be classified as “sensitive” under certain privacy laws (“sensitive information”): Information relating to racial and ethnic origin.

We use this sensitive information for the purposes set forth in the How We Use, Store, and Share Recruiting Data section above.

We do not sell sensitive information, and we do not process or otherwise share sensitive information for the purpose of targeted advertising. However, subject to certain legal limitations and exceptions, you may be able to limit our processing of sensitive information (as described in the Your Rights and How to Exercise Them section below).

Your Rights and How to Exercise Them

Depending on your jurisdiction, you may have the following rights with respect to your personal information. You can exercise any of these rights by contacting our Data Privacy Team at privacy@nvidia.com

  • Right to access - You have the right to access and review your personal data.
  • Right to take your data - You have the right to obtain a copy of your personal data.
  • Right to erasure - You have the right to request that we erase your personal data.
  • Right to restrict use - You have the right to request that we stop using your personal data for any purpose.
  • Right to correction - You have the right to request that any inaccuracies in your personal data be corrected, taking into account the nature of the personal data and the purposes of the processing of your personal data.
  • Right to limit use and disclosure of sensitive personal information - You have the right to direct us to limit the use of your sensitive personal information to certain purposes, including to perform the services reasonably expected.
  • Right to lodge a complaint - If you feel we've failed in any way, you have the right to lodge a complaint with us, or with a data protection authority in your location.

You also have the right to not receive retaliatory or discriminatory treatment in connection with a request to exercise the above rights. However, please note that if the exercise of these rights limits our ability to process personal data, we may no longer be able to engage with you in the same manner.

Before processing your request, we will need to verify your identity. In order to verify your identity, we may at times need to request additional personal data from you, taking into consideration our relationship with you and the sensitivity of your request.  In certain circumstances, we may decline a privacy rights request, particularly where we are unable to verify your identity.

Authorized Agents

In certain circumstances, you are permitted to use an authorized agent to submit requests on your behalf through the designated methods set forth above where we can verify the authorized agent’s authority to act on your behalf. In order to verify the authorized agent’s authority, we generally require evidence of either (i) a valid power of attorney or (ii) a signed letter containing your name and contact information, the name and contact information of the authorized agent, and a statement of authorization for the request. Depending on the evidence provided, we may still need to separately reach out to you to confirm the authorized agent has permission to act on your behalf and to verify your identity in connection with the request.
